Clause 20 & Arbitration
Clause 20 of the NAEGA No. 2 provides protection for sellers whose commodity deliveries have been prevented or delayed due to circumstances detailed in Clause 20 (b), including strikes, riots, political actions and natural disasters. Under the NAEGA No. 2, when sellers invoke Clause 20, NAEGA conducts a certification process to confirm the validity of the cause.
For non-members, costs of certification range between $10,000 and $50,000. As a NAEGA member, there is no charge for Clause 20 certification proceedings.
NAEGA membership saves principals tens of thousands of dollars should a significant matter occur.
NAEGA members also benefit from access to a cost-effective dispute resolution process tailored specifically to the agricultural trade. NAEGA maintains a list of arbitrators and special grain arbitrators approved to arbitrate under the American Arbitration Association’s International Centre for Dispute Resolution. A panel is made available for NAEGA members to arbitrate disputes as they arise, as detailed in Clause 30. Conducted under New York State law, NAEGA arbitration affords members industry experience and contract-specific support, while reducing professional and administrative costs compared to proceedings under English law.
NAEGA membership can protect both counterparty relationships and the bottom line when disruptions or contractual disputes occur.
